Terms of service

The rules for using Foverix software, licenses, managed services, and support.

1. Scope and contracting party

These terms are intended to govern the Foverix macOS application, related licensing services, Managed AI, updates, websites, and support supplied by a German sole proprietor trading as Foverix. The proprietor is Mohammadamin Ghalebi, c/o Impressumservice Dein-Impressum, Stettiner Str. 41, 35410 Hungen, Germany (see the Impressum). Contact: support@foverix.com.

If you buy through Paddle, Paddle acts as Merchant of Record for the transaction. Paddle's buyer terms also apply to payment, tax, invoicing, and transaction administration.

2. Account and software license

Subject to payment and these terms, Foverix grants the purchaser a limited, non-exclusive, non-transferable right to install and use the software for the licensed scope. A license is for the purchaser and their own work unless a business, team, or enterprise offer expressly says otherwise.

You are responsible for safeguarding license credentials and provider keys. You must not publish, sell, share, bypass, forge, or automate abuse of a license or usage allowance. Reasonable device activation and validation checks may be used to enforce the purchased scope.

Free trial

A 14-day trial starts automatically the first time the app reaches the Foverix licensing service from a Mac. No purchase, card, or account is required. The trial is issued once per device: the app sends a device identifier and receives a signed receipt valid for exactly 14 days, and asking again for the same device returns that same window instead of a new one. During the trial the app is not limited to the Free monthly image allowance. When the 14 days elapse, the app continues on the Free tier — nothing is charged and there is nothing to cancel.

Activation and deactivation

A purchased license is activated inside the app under Settings → General → License, using the key sent to the purchase email address. A license may hold up to two device activations at a time. Deactivate, in the same place, releases one activation so the license can be used on another Mac. A paid license is re-checked when the app can reach the licensing service and keeps working offline for a bounded grace period of 14 days; a trial receipt is not re-checked on a fixed schedule.

Subscriptions

Pro renews for the selected monthly or annual period until cancelled. Cancellation stops future renewal but does not normally reverse a completed billing period. Access and included usage continue through the paid period unless the account is terminated for serious misuse.

One-time licenses

Lifetime Local and Founder's Lifetime are one-time licenses for the version scope described at purchase. Point updates are intended to be included; a materially new major version may be offered separately. “Lifetime” refers to the supported commercial life of that edition, not the purchaser's lifetime or a promise of perpetual service availability.

3. AI processing and output

You choose among supported local, bring-your-own-key, and managed processing paths. Cloud-provider terms may apply. AI-assisted titles, descriptions, keywords, classifications, and quality signals can be incomplete or wrong. You remain responsible for reviewing output, protecting rights in submitted material, and meeting each agency's rules. Foverix does not guarantee acceptance, ranking, licensing income, or any commercial result.

4. Prices, credits, renewals, and refunds

Current offers are described on the pricing page. Prices are stated in USD unless shown otherwise. Paddle may calculate tax at checkout. Managed-AI allowances and credit packs are measured using the launch rules shown at purchase; local or BYOK operations do not consume managed credits unless clearly stated in the app.

Refund requests are handled under the refund policy, Paddle's applicable process, and mandatory law. These terms do not waive mandatory consumer rights.

5. Acceptable use

You may not use Foverix to break the law; violate privacy, publicity, intellectual-property, or contractual rights; distribute malware; probe or disrupt the service; evade usage or security controls; resell access without permission; or submit content you have no right to process. Automated use must stay within documented interfaces and reasonable limits.

6. Your content and intellectual property

You retain your rights in your photos, metadata, and other content. You give Foverix and relevant providers only the permissions needed to perform operations you request, secure the service, and meet legal obligations. The Foverix software, branding, interface, documentation, and service technology remain protected by applicable intellectual-property law.

7. Availability, changes, and termination

Foverix may update the app, models, limits, integrations, and managed services to improve reliability, security, compatibility, or legal compliance. Online components can experience interruption. Foverix may suspend access reasonably needed to address security, payment failure, unlawful use, or material breach, with notice where practical and lawful.

8. Warranty and liability

Nothing in these terms excludes liability or remedies that cannot lawfully be excluded. Subject to that rule, the service is provided with the level of care required by applicable law, and no promise is made that automated output will be error-free or suitable for a particular agency decision.

9. Governing law and disputes

These terms are governed by the law of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). Your contracting partner is the operator identified in the Impressum. If you are a consumer, the mandatory consumer-protection rules of the country in which you habitually reside remain unaffected, and the statutory rules determine the competent court. Before escalating a concern, contact support@foverix.com so the issue can be investigated.

10. Changes to these terms

Material changes will be presented with an updated date and, where required, advance notice. The version accepted for a purchase remains available to the extent required by law.
